Terms of Service

1. Acceptance of Terms

By accessing or using Pulse ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. Pulse is operated by Pulse AI Coach ("we", "us", or "our"). These Terms apply to all users, including free trial users and paid subscribers.

2. Description of Service

Pulse is an AI-powered trading psychology coaching platform. The Service includes:

• AI coaching conversations via web, mobile app, and Discord
• Psychological scoring, pattern analysis, and weekly reports
• Risk Shield tilt detection and intervention system
• Optional broker account integration with risk management (Tradovate / NinjaTrader®)
• Trade session tracking and behavioral analytics

Pulse is a coaching and wellness tool. It is not a financial advisor, broker-dealer, investment advisor, or trading platform. Nothing in the Service constitutes financial advice. See our Risk Disclosure for full details.

3. Eligibility

You must be at least 18 years old to use Pulse. By using the Service, you represent that you are 18 or older and have the legal capacity to enter into these Terms. Pulse is intended for individual traders and is not designed for use by minors.

4. Account Registration

You may register using Google, Discord, or Apple OAuth, or with an email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate, current, and complete information during registration and to update it as needed. We reserve the right to suspend or terminate accounts that violate these Terms or provide false information.

5. Subscriptions & Billing

Pulse offers a 7-day free trial followed by a paid monthly subscription. Billing is handled by Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel.

• Subscriptions renew automatically at the end of each billing period
• You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period
• No refunds are provided for partial billing periods
• We reserve the right to change pricing with 30 days' notice to existing subscribers

If payment fails, your account may be downgraded or suspended until payment is resolved.

6. Free Trial

New users receive a 7-day free trial with full access to all features. No credit card is required to start a trial. At the end of the trial period, continued use requires a paid subscription. We reserve the right to modify or discontinue free trial offers at any time.

7. Broker Account Integration

Pulse offers optional OAuth-based integration with Tradovate and NinjaTrader® accounts. By connecting a broker account, you grant Pulse access to your account data — including balance, P&L, drawdown, and trade fills — for the purpose of providing psychological coaching context. If you enable the Risk Shield feature, you also grant Pulse permission to adjust risk settings (such as daily loss limits) on your behalf. You can disable Risk Shield or override any risk setting changes at any time from your account settings.

You understand and agree that:

• Pulse never executes trades, opens or closes positions, or accesses funds
• If Risk Shield is enabled, Pulse may adjust risk settings (e.g. daily loss limits) — you can disable or override this at any time in your account settings
• Broker data displayed within Pulse may be delayed or inaccurate due to API latency
• Drawdown alerts are informational coaching prompts, not guaranteed financial warnings
• You remain solely responsible for monitoring your own trading accounts
• You may disconnect your broker account at any time

Pulse is not affiliated with, endorsed by, or sponsored by Tradovate, NinjaTrader®, or any prop trading firm.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse-engineer, scrape, or extract data from the Service
• Share your account credentials with others or allow others to access your account
• Use automated tools, bots, or scripts to access the Service without our written consent
• Upload or transmit malicious code, viruses, or disruptive content
• Harass, abuse, or harm other users or Pulse staff
• Attempt to circumvent any subscription or access controls

9. AI-Generated Content

Pulse's coaching responses are generated by Anthropic's Claude AI model. AI-generated content may occasionally be inaccurate, incomplete, or not suitable for your specific situation.

Pulse's coaching is not a substitute for professional mental health care, therapy, or financial advice. If you are experiencing a mental health crisis, please contact a qualified professional or the 988 Suicide & Crisis Lifeline immediately. Pulse includes crisis detection features but cannot guarantee their accuracy or completeness.

10. Intellectual Property

All content, features, and functionality of the Service — including the Pulse name, logo, software, AI models, and reports — are owned by us and protected by applicable intellectual property laws.

You retain ownership of the content you submit (your conversations, journal entries, and trade data). By using the Service, you grant us a limited license to use that content solely to provide and improve the Service. We do not claim ownership of your data.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. WE DO NOT WARRANT THAT BROKER DATA DISPLAYED IN THE SERVICE IS ACCURATE, COMPLETE, OR REAL-TIME. USE OF THE SERVICE IS AT YOUR SOLE RISK.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO TRADING LOSSES, LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 3 MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless Pulse, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, violation of these Terms, or violation of any third-party rights.

15. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may terminate your account at any time by contacting us at support@pulseaicoach.com. Upon termination, your right to use the Service ceases immediately.

16. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts located in Nevada.

17. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or in-app notice at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
